勞務派遣的形式主要有哪些?

關于勞(lao)務派(pai)遣(qian)(qian),目(mu)前還沒有一(yi)個統一(yi)的概念,一(yi)般是指(zhi)由(you)勞(lao)務派(pai)遣(qian)(qian)單位(wei)與勞(lao)動(dong)者訂立勞(lao)動(dong)合(he)同,與用(yong)工(gong)單位(wei)簽訂勞(lao)務派(pai)遣(qian)(qian)協(xie)議,將(jiang)勞(lao)動(dong)者派(pai)遣(qian)(qian)到用(yong)工(gong)單位(wei)工(gong)作(zuo)的一(yi)種(zhong)用(yong)工(gong)形式。


勞務派遣的形式主要有:


1、完全(quan)派遣(qian) 就是用(yong)工(gong)單(dan)位將一(yi)些非核心(xin)員(yuan)工(gong)(如文員(yuan)、保安、司機、炊事(shi)員(yuan)、搬(ban)運工(gong)、清(qing)潔工(gong)等(deng))或一(yi)些非專業(ye)性工(gong)作(如物業(ye)管理(li)(li)(li)、清(qing)潔衛生、搬(ban)運等(deng)),外包(bao)給勞(lao)務(wu)派遣(qian)公司。雙方簽訂勞(lao)務(wu)派遣(qian)協議,由勞(lao)務(wu)派遣(qian)公司承(cheng)(cheng)擔這(zhe)部分派遣(qian)員(yuan)工(gong)整套(tao)人力資(zi)源管理(li)(li)(li)服務(wu)工(gong)作(包(bao)括招(zhao)聘錄用(yong)、勞(lao)動合同管理(li)(li)(li)、績效管理(li)(li)(li)、安全(quan)生產管理(li)(li)(li)、工(gong)資(zi)管理(li)(li)(li)、保險福(fu)利管理(li)(li)(li)、計劃生育(yu)管理(li)(li)(li)等(deng)),并承(cheng)(cheng)擔所(suo)有的(de)勞(lao)動人事(shi)風險責任。


2、轉移派遣 就是(shi)(shi)用(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)位(wei)(wei)還(huan)需(xu)要繼(ji)續使(shi)(shi)用(yong)(yong)(yong)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)期(qi)滿終止(zhi)后的(de)員(yuan)工(gong)(gong),但是(shi)(shi)不想(xiang)保留原(yuan)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系,因而將勞(lao)(lao)動(dong)(dong)(dong)關(guan)系轉移給(gei)勞(lao)(lao)務(wu)派遣公(gong)司(si),由勞(lao)(lao)務(wu)派遣公(gong)司(si)與這些員(yuan)工(gong)(gong)簽(qian)訂(ding)(ding)勞(lao)(lao)動(dong)(dong)(dong)合同(tong),勞(lao)(lao)務(wu)派遣公(gong)司(si)與用(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)位(wei)(wei)簽(qian)訂(ding)(ding)勞(lao)(lao)務(wu)派遣協(xie)議,由用(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)位(wei)(wei)繼(ji)續使(shi)(shi)用(yong)(yong)(yong)這些人(ren)員(yuan);用(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)位(wei)(wei)只需(xu)向派遣公(gong)司(si)支付員(yuan)工(gong)(gong)派遣金和服務(wu)費,與所使(shi)(shi)用(yong)(yong)(yong)的(de)員(yuan)工(gong)(gong)不產生(sheng)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系,這樣(yang)可幫助用(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)位(wei)(wei)有效實現員(yuan)工(gong)(gong)崗位(wei)(wei)調整,或跨(kua)地(di)區調動(dong)(dong)(dong),從而有效規避員(yuan)工(gong)(gong)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)變(bian)更以及續簽(qian)無固定(ding)期(qi)限勞(lao)(lao)動(dong)(dong)(dong)合同(tong)的(de)風險。


3、減(jian)員(yuan)派(pai)(pai)遣(qian) 就是(shi)用工(gong)單位在經濟性裁(cai)員(yuan)或改制(zhi)裁(cai)員(yuan)時,將被裁(cai)減(jian)員(yuan)工(gong)勞(lao)動(dong)關系轉(zhuan)移(yi)到(dao)勞(lao)務(wu)派(pai)(pai)遣(qian)公(gong)(gong)司(si)(si),由勞(lao)務(wu)派(pai)(pai)遣(qian)公(gong)(gong)司(si)(si)與這些被裁(cai)減(jian)員(yuan)工(gong)簽訂(ding)勞(lao)動(dong)合同;勞(lao)務(wu)派(pai)(pai)遣(qian)公(gong)(gong)司(si)(si)再將這些人(ren)員(yuan)派(pai)(pai)遣(qian)到(dao)用工(gong)單位使用,用工(gong)單位向勞(lao)務(wu)派(pai)(pai)遣(qian)公(gong)(gong)司(si)(si)支付派(pai)(pai)遣(qian)員(yuan)工(gong)勞(lao)務(wu)費用,從而可幫助用工(gong)單位降低人(ren)員(yuan)成本和管理(li)成本。

5、短期派遣(qian) 就是指用工單(dan)位(wei)(wei)對于(yu)短期項目需要或者流動性(xing)比較大(da)的(de)職位(wei)(wei)采用短期勞(lao)務派遣(qian)的(de)方式進(jin)行用工,減少用工手(shou)續上(shang)的(de)麻煩,避免勞(lao)動關系上(shang)的(de)風險。
