勞務派遣的形式主要有哪些?發表時間:2021-12-06 11:43 關于勞(lao)(lao)務(wu)派遣,目前(qian)還沒有一個(ge)統一的概念(nian),一般是指由勞(lao)(lao)務(wu)派遣單位(wei)(wei)與勞(lao)(lao)動者訂立(li)勞(lao)(lao)動合同(tong),與用工單位(wei)(wei)簽訂勞(lao)(lao)務(wu)派遣協議,將勞(lao)(lao)動者派遣到用工單位(wei)(wei)工作的一種(zhong)用工形式。 勞務派(pai)遣的形式(shi)主(zhu)要(yao)有: 1、完全(quan)派(pai)遣 就(jiu)是用(yong)工(gong)單位(wei)將一些非(fei)核(he)心(xin)員(yuan)工(gong)(如(ru)文(wen)員(yuan)、保安(an)、司機、炊事(shi)員(yuan)、搬運工(gong)、清(qing)潔工(gong)等(deng)(deng))或一些非(fei)專業性工(gong)作(如(ru)物業管(guan)理(li)(li)、清(qing)潔衛(wei)生、搬運等(deng)(deng)),外(wai)包給勞(lao)(lao)務派(pai)遣公司。雙方簽訂勞(lao)(lao)務派(pai)遣協議,由勞(lao)(lao)務派(pai)遣公司承擔這部分派(pai)遣員(yuan)工(gong)整套人(ren)力(li)資源管(guan)理(li)(li)服務工(gong)作(包括招(zhao)聘錄用(yong)、勞(lao)(lao)動合同管(guan)理(li)(li)、績效(xiao)管(guan)理(li)(li)、安(an)全(quan)生產管(guan)理(li)(li)、工(gong)資管(guan)理(li)(li)、保險福利管(guan)理(li)(li)、計劃(hua)生育管(guan)理(li)(li)等(deng)(deng)),并承擔所有的勞(lao)(lao)動人(ren)事(shi)風(feng)險責任。 2、轉移派(pai)遣 就是用(yong)工單位(wei)還需要繼續使用(yong)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)期(qi)滿終止后的(de)員(yuan)工,但是不想保(bao)留原勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi),因而(er)將勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)轉移給勞(lao)(lao)(lao)務派(pai)遣公司,由(you)勞(lao)(lao)(lao)務派(pai)遣公司與這(zhe)些(xie)員(yuan)工簽訂勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong),勞(lao)(lao)(lao)務派(pai)遣公司與用(yong)工單位(wei)簽訂勞(lao)(lao)(lao)務派(pai)遣協(xie)議,由(you)用(yong)工單位(wei)繼續使用(yong)這(zhe)些(xie)人員(yuan);用(yong)工單位(wei)只需向派(pai)遣公司支付員(yuan)工派(pai)遣金和服務費,與所使用(yong)的(de)員(yuan)工不產生勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi),這(zhe)樣可幫助用(yong)工單位(wei)有效實現(xian)員(yuan)工崗位(wei)調整,或跨地區調動(dong)(dong)(dong),從而(er)有效規避員(yuan)工勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)變(bian)更以(yi)及續簽無固定期(qi)限勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)風險。 3、減員派(pai)(pai)(pai)遣 就是(shi)用(yong)工(gong)單(dan)位(wei)(wei)在經(jing)濟性裁員或改制裁員時(shi),將被裁減員工(gong)勞(lao)(lao)動(dong)關系轉移到勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣公(gong)司(si),由勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣公(gong)司(si)與(yu)這(zhe)些被裁減員工(gong)簽訂勞(lao)(lao)動(dong)合同;勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣公(gong)司(si)再將這(zhe)些人員派(pai)(pai)(pai)遣到用(yong)工(gong)單(dan)位(wei)(wei)使用(yong),用(yong)工(gong)單(dan)位(wei)(wei)向勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣公(gong)司(si)支付(fu)派(pai)(pai)(pai)遣員工(gong)勞(lao)(lao)務(wu)費(fei)用(yong),從而可幫助用(yong)工(gong)單(dan)位(wei)(wei)降低人員成本和管理成本。 4、試(shi)(shi)用(yong)(yong)派遣 根(gen)據國家勞(lao)(lao)(lao)(lao)動法律法規規定(ding),勞(lao)(lao)(lao)(lao)動合同(tong)期(qi)限為一(yi)年的,員工(gong)(gong)試(shi)(shi)用(yong)(yong)期(qi)為一(yi)個(ge)(ge)月,最(zui)長試(shi)(shi)用(yong)(yong)期(qi)只(zhi)有6個(ge)(ge)月。而(er)從心(xin)理(li)學的角度(du),對一(yi)個(ge)(ge)人的全(quan)面(mian)了解需要2年的時(shi)間,為了規避勞(lao)(lao)(lao)(lao)動法規定(ding)的試(shi)(shi)用(yong)(yong)期(qi)時(shi)間太短,而(er)又對新(xin)員工(gong)(gong)需要有一(yi)個(ge)(ge)較全(quan)面(mian)了解的矛盾,用(yong)(yong)工(gong)(gong)單位(wei)可將新(xin)招聘員工(gong)(gong)勞(lao)(lao)(lao)(lao)動關(guan)系轉移到勞(lao)(lao)(lao)(lao)務(wu)派遣公司,由勞(lao)(lao)(lao)(lao)務(wu)派遣公司簽(qian)訂勞(lao)(lao)(lao)(lao)動合同(tong);用(yong)(yong)工(gong)(gong)單位(wei)再以勞(lao)(lao)(lao)(lao)務(wu)派遣的形(xing)式試(shi)(shi)用(yong)(yong),對新(xin)員工(gong)(gong)的忠誠度(du)、敬業(ye)精種(zhong)、責任心(xin)和(he)專業(ye)技術(shu)能力,進(jin)行全(quan)面(mian)的了解、考察,并最(zui)后決定(ding)是(shi)否長期(qi)使(shi)用(yong)(yong)并簽(qian)訂勞(lao)(lao)(lao)(lao)動合同(tong),可有效降低(di)新(xin)員工(gong)(gong)使(shi)用(yong)(yong)風險。 5、短期派遣 就是指用(yong)工單位對(dui)于短期項目需要或者流動性比較大的職(zhi)位采用(yong)短期勞(lao)務(wu)派遣的方式(shi)進行用(yong)工,減少用(yong)工手續上的麻煩,避免勞(lao)動關(guan)系上的風險。 |
