    其(qi)次,要(yao)依法(fa)簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)和勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)合(he)同(tong)。作(zuo)(zuo)(zuo)為具有法(fa)人(ren)(ren)資格的勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)型(xing)企(qi)業,應與(yu)招聘錄用(yong)的勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)員(yuan)簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),依法(fa)建(jian)立(li)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系,明(ming)確雙方(fang)(fang)的權利(li)和義務(wu)(wu),特別(bie)是明(ming)確作(zuo)(zuo)(zuo)為勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)派遣的用(yong)人(ren)(ren)單位(wei)及(ji)(ji)工(gong)種崗(gang)位(wei)、工(gong)作(zuo)(zuo)(zuo)時間(jian)、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報(bao)(bao)酬(chou)及(ji)(ji)工(gong)資支付(fu)(fu)方(fang)(fang)式,參加社會保(bao)險等,并在當地(di)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)障部門辦理相(xiang)關(guan)的勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)用(yong)工(gong)、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)簽(qian)訂證和社會保(bao)險登記、申報(bao)(bao)、繳費手續。勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)型(xing)公司(si)在進行(xing)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)派遣時,還必須與(yu)企(qi)事業用(yong)人(ren)(ren)單位(wei)簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)協議(yi),依法(fa)建(jian)立(li)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)派遣與(yu)使用(yong)關(guan)系,明(ming)確勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)派遣人(ren)(ren)員(yuan)的工(gong)作(zuo)(zuo)(zuo)崗(gang)位(wei)、工(gong)作(zuo)(zuo)(zuo)時間(jian)、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報(bao)(bao)酬(chou)標(biao)(biao)準,以及(ji)(ji)社會保(bao)險費結付(fu)(fu)標(biao)(biao)準和繳納辦法(fa)。可以說(shuo),勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)型(xing)公司(si)與(yu)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)員(yuan)簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)、與(yu)用(yong)人(ren)(ren)單位(wei)簽(qian)訂勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)合(he)同(tong),是依法(fa)規(gui)范用(yong)工(gong)、避免勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)爭議(yi)和勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)糾紛的最重要(yao)的基(ji)礎工(gong)作(zuo)(zuo)(zuo)。

    第(di)三、要做好對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)跟蹤(zong)管(guan)理和服務(wu)(wu)(wu)(wu)(wu)(wu)。勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)公(gong)(gong)司不(bu)能(neng)(neng)只管(guan)收(shou)費(fei)(fei),還應(ying)認真履行管(guan)理和服務(wu)(wu)(wu)(wu)(wu)(wu)的(de)(de)職責和義務(wu)(wu)(wu)(wu)(wu)(wu),主動(dong)按(an)月與用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)核對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)支付、社會(hui)保(bao)(bao)(bao)險(xian)(xian)費(fei)(fei)和考(kao)勤、工(gong)(gong)(gong)作(zuo)(zuo)業(ye)績考(kao)核等(deng)(deng)資(zi)(zi)料(liao),并(bing)(bing)將用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)反饋(kui)的(de)(de)原始資(zi)(zi)料(liao)保(bao)(bao)(bao)存備案,接(jie)受勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)(bao)(bao)障行政部(bu)門(men)的(de)(de)監督檢查。作(zuo)(zuo)為用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei),不(bu)能(neng)(neng)只管(guan)用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren),要求勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)提供(gong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu),而應(ying)嚴格遵(zun)守勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)(bao)(bao)障法(fa)律(lv)法(fa)規,對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)合理安排工(gong)(gong)(gong)作(zuo)(zuo)崗(gang)位(wei)、工(gong)(gong)(gong)作(zuo)(zuo)時間,提供(gong)必要的(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)(bao)(bao)護(hu)條件,進行崗(gang)位(wei)培訓,做思(si)想教育工(gong)(gong)(gong)作(zuo)(zuo),調動(dong)他們的(de)(de)積極性,并(bing)(bing)按(an)月將所使(shi)用(yong)(yong)(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)支付、社會(hui)保(bao)(bao)(bao)險(xian)(xian)費(fei)(fei)結(jie)轉(zhuan)和考(kao)勤、業(ye)績等(deng)(deng)資(zi)(zi)料(liao)反饋(kui)給勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)公(gong)(gong)司。勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)可以由(you)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)企(qi)(qi)業(ye)按(an)月足額發放,并(bing)(bing)依法(fa)代扣代繳(jiao)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)人(ren)(ren)(ren)(ren)(ren)員(yuan)個人(ren)(ren)(ren)(ren)(ren)應(ying)繳(jiao)納(na)的(de)(de)社會(hui)保(bao)(bao)(bao)險(xian)(xian)費(fei)(fei);也可以由(you)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)企(qi)(qi)業(ye)與使(shi)用(yong)(yong)(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)約(yue)定,由(you)使(shi)用(yong)(yong)(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)按(an)月足額支付工(gong)(gong)(gong)資(zi)(zi)和代扣個人(ren)(ren)(ren)(ren)(ren)應(ying)繳(jiao)納(na)的(de)(de)社會(hui)保(bao)(bao)(bao)險(xian)(xian)費(fei)(fei),代扣的(de)(de)個人(ren)(ren)(ren)(ren)(ren)應(ying)繳(jiao)的(de)(de)社會(hui)保(bao)(bao)(bao)險(xian)(xian)費(fei)(fei)應(ying)劃轉(zhuan)給勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)企(qi)(qi)業(ye),并(bing)(bing)將約(yue)定內容(rong)書面告知勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者;使(shi)用(yong)(yong)(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)(qian)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)未按(an)照約(yue)定承擔勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者義務(wu)(wu)(wu)(wu)(wu)(wu)的(de)(de),由(you)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)企(qi)(qi)業(ye)承擔對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者的(de)(de)義務(wu)(wu)(wu)(wu)(wu)(wu)。通過勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)型(xing)公(gong)(gong)司與用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)各司其職,形成合力(li),共同做好對勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)管(guan)理和服務(wu)(wu)(wu)(wu)(wu)(wu)工(gong)(gong)(gong)作(zuo)(zuo),切實使(shi)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)的(de)(de)權益得到(dao)保(bao)(bao)(bao)障。

    后,要加(jia)(jia)強對(dui)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)的執法(fa)(fa)(fa)監(jian)察。為(wei)維護勞(lao)(lao)(lao)動(dong)(dong)力市場秩序和(he)(he)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)人(ren)(ren)(ren)(ren)員(yuan)的合(he)(he)法(fa)(fa)(fa)權(quan)益,各地勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)障(zhang)(zhang)部(bu)門應加(jia)(jia)強對(dui)勞(lao)(lao)(lao)務(wu)(wu)型(xing)公(gong)(gong)司(si)派(pai)(pai)遣(qian)(qian)(qian)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)和(he)(he)用(yong)人(ren)(ren)(ren)(ren)單位(wei)使(shi)用(yong)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)的執法(fa)(fa)(fa)監(jian)察,重點是監(jian)督(du)檢查勞(lao)(lao)(lao)務(wu)(wu)型(xing)公(gong)(gong)司(si)與勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)簽訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同、依法(fa)(fa)(fa)建立勞(lao)(lao)(lao)動(dong)(dong)關(guan)系情況,為(wei)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)辦理并繳納(na)社會保(bao)(bao)險費情況;監(jian)督(du)、檢查用(yong)人(ren)(ren)(ren)(ren)單位(wei)使(shi)用(yong)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)工資支付、工作時間(jian)、勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)護、休息(xi)休假的情況。對(dui)違(wei)反勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)律法(fa)(fa)(fa)規及勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)政(zheng)策規定的勞(lao)(lao)(lao)務(wu)(wu)型(xing)公(gong)(gong)司(si)和(he)(he)用(yong)人(ren)(ren)(ren)(ren)單位(wei),勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)障(zhang)(zhang)行(xing)政(zheng)部(bu)門依法(fa)(fa)(fa)責令限期改正,并依據勞(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)障(zhang)(zhang)法(fa)(fa)(fa)律、法(fa)(fa)(fa)規、規章的相(xiang)關(guan)規定予(yu)以(yi)處理處罰(fa),以(yi)確保(bao)(bao)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)(qian)和(he)(he)使(shi)用(yong)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)行(xing)為(wei)的規范(fan)化(hua),確保(bao)(bao)勞(lao)(lao)(lao)務(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)的合(he)(he)法(fa)(fa)(fa)權(quan)益不受侵害。
