勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派遣中的(de)(de)(de)(de)問題(ti),主(zhu)要有:一是(shi)(shi)勞(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系不(bu)(bu)(bu)清晰。勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型公司(si)與用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)簽訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派遣協議,用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)不(bu)(bu)(bu)直接與勞(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)簽訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動合(he)同,造(zao)成(cheng)勞(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)勞(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系和工作崗(gang)位(wei)(wei)分(fen)別屬于兩(liang)家(jia)(jia)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)(de)(de)情(qing)況(kuang)。二是(shi)(shi)工資(zi)(zi)支(zhi)付不(bu)(bu)(bu)透明。由于勞(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系和工作崗(gang)位(wei)(wei)分(fen)屬兩(liang)家(jia)(jia),出(chu)(chu)現(xian)部分(fen)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型企(qi)業(ye)(ye)及用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)隨意克扣工資(zi)(zi),不(bu)(bu)(bu)按(an)月發(fa)放工資(zi)(zi)、不(bu)(bu)(bu)按(an)規(gui)定結付加(jia)(jia)班工資(zi)(zi)等(deng)情(qing)況(kuang),勞(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)的(de)(de)(de)(de)權益受侵害后責任(ren)主(zhu)體不(bu)(bu)(bu)明確。三(san)是(shi)(shi)社(she)會保(bao)險不(bu)(bu)(bu)參加(jia)(jia)。有的(de)(de)(de)(de)用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)利(li)用(yong)(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派遣用(yong)(yong)人(ren)(ren)(ren)(ren)形式(shi),逃避社(she)會保(bao)險義務(wu)(wu)(wu)(wu)(wu),而勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型公司(si)又不(bu)(bu)(bu)為勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)辦理參保(bao)手續,不(bu)(bu)(bu)繳納(na)社(she)保(bao)費(fei),或(huo)者(zhe)(zhe)是(shi)(shi)讓勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)自(zi)己承擔繳納(na)全(quan)部的(de)(de)(de)(de)社(she)保(bao)費(fei)。四是(shi)(shi)同等(deng)勞(lao)(lao)(lao)(lao)(lao)(lao)動不(bu)(bu)(bu)同報酬(chou)。勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)在用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)往往成(cheng)為另(ling)類,從事的(de)(de)(de)(de)是(shi)(shi)苦、臟、累、重的(de)(de)(de)(de)工作,報酬(chou)待遇低,不(bu)(bu)(bu)享受用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)(de)(de)獎金和福利(li)等(deng)。五是(shi)(shi)工作時間(jian)不(bu)(bu)(bu)規(gui)范。被派遣的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)需(xu)遵守用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)(de)(de)工作時間(jian),這(zhe)本屬正常(chang),但有的(de)(de)(de)(de)用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)對(dui)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)任(ren)意安排加(jia)(jia)班加(jia)(jia)點,工作時間(jian)大大超過(guo)國家(jia)(jia)規(gui)定,并且不(bu)(bu)(bu)按(an)規(gui)定支(zhi)付加(jia)(jia)班工資(zi)(zi),還把違章(zhang)責任(ren)推卸給勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型企(qi)業(ye)(ye)。勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型企(qi)業(ye)(ye)為與用(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)維持勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派遣關(guan)系,不(bu)(bu)(bu)敢幫勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)維權。六是(shi)(shi)員(yuan)(yuan)工結構不(bu)(bu)(bu)合(he)理。一些經濟欠發(fa)地(di)(di)區的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型公司(si),以(yi)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派遣形式(shi),大量向沿海經濟發(fa)達(da)城市(shi)(shi)的(de)(de)(de)(de)企(qi)業(ye)(ye)派遣“低價”勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan),造(zao)成(cheng)這(zhe)些企(qi)業(ye)(ye)用(yong)(yong)人(ren)(ren)(ren)(ren)結構出(chu)(chu)現(xian)正式(shi)員(yuan)(yuan)工少、勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan)多的(de)(de)(de)(de)不(bu)(bu)(bu)正常(chang)現(xian)象。有的(de)(de)(de)(de)企(qi)業(ye)(ye)甚至整條(tiao)生(sheng)產線包(bao)給外(wai)地(di)(di)勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型公司(si),再由勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型公司(si)招收勞(lao)(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)員(yuan)(yuan),采取“外(wai)包(bao)內做”形式(shi)。以(yi)上這(zhe)些問題(ti),對(dui)勞(lao)(lao)(lao)(lao)(lao)(lao)動力(li)市(shi)(shi)場秩(zhi)序、社(she)會保(bao)險和勞(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)權益都產生(sheng)不(bu)(bu)(bu)利(li)的(de)(de)(de)(de)影響(xiang)。 首先(xian),要(yao)明(ming)確規定勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)的(de)范(fan)圍(wei)。企(qi)(qi)(qi)事(shi)業(ye)(ye)單位(wei)(wei)用(yong)(yong)工(gong)(gong),應以(yi)(yi)直接(jie)招聘錄用(yong)(yong)員(yuan)工(gong)(gong),并(bing)簽(qian)訂勞(lao)(lao)(lao)(lao)動合同(tong),建(jian)(jian)(jian)立(li)正式勞(lao)(lao)(lao)(lao)動關系,建(jian)(jian)(jian)立(li)一支基本(ben)職(zhi)工(gong)(gong)隊伍為(wei)主,而勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)作(zuo)(zuo)為(wei)一種特(te)殊(shu)的(de)用(yong)(yong)工(gong)(gong)形式和勞(lao)(lao)(lao)(lao)動關系,并(bing)不適(shi)合所(suo)有(you)企(qi)(qi)(qi)事(shi)業(ye)(ye)用(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)(wei),只適(shi)合一些特(te)殊(shu)用(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單位(wei)(wei)或(huo)特(te)殊(shu)崗(gang)位(wei)(wei)。因(yin)此,勞(lao)(lao)(lao)(lao)動保障部門(men)對勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)型公(gong)(gong)(gong)司(si)進(jin)(jin)行(xing)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian),應明(ming)確規定派(pai)(pai)(pai)遣(qian)的(de)范(fan)圍(wei)。如外地企(qi)(qi)(qi)業(ye)(ye)進(jin)(jin)入(ru)當地設立(li)的(de)非法(fa)人(ren)(ren)(ren)(ren)(ren)分支機構(gou)(gou)或(huo)當地未(wei)注冊機構(gou)(gou)的(de)所(suo)需用(yong)(yong)工(gong)(gong),因(yin)其不具法(fa)人(ren)(ren)(ren)(ren)(ren)資格而不能直接(jie)招用(yong)(yong)工(gong)(gong),與員(yuan)工(gong)(gong)建(jian)(jian)(jian)立(li)勞(lao)(lao)(lao)(lao)動關系,所(suo)以(yi)(yi)要(yao)由(you)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)型公(gong)(gong)(gong)司(si)派(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)供(gong)其使用(yong)(yong)。再如,企(qi)(qi)(qi)業(ye)(ye)的(de)保安、保潔、綠化養(yang)護等(deng)特(te)殊(shu)崗(gang)位(wei)(wei)用(yong)(yong)人(ren)(ren)(ren)(ren)(ren),銀(yin)行(xing)、保險公(gong)(gong)(gong)司(si)因(yin)編(bian)制所(suo)限需使用(yong)(yong)編(bian)外人(ren)(ren)(ren)(ren)(ren)員(yuan),也(ye)可由(you)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)公(gong)(gong)(gong)司(si)派(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)人(ren)(ren)(ren)(ren)(ren)員(yuan)。 其次(ci),要(yao)依法簽(qian)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合同(tong)和(he)勞(lao)(lao)(lao)(lao)(lao)(lao)務合同(tong)。作(zuo)(zuo)(zuo)為(wei)具有(you)法人(ren)(ren)(ren)資格(ge)的(de)勞(lao)(lao)(lao)(lao)(lao)(lao)務型企業(ye),應(ying)與(yu)招聘錄(lu)用(yong)的(de)勞(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)(ren)(ren)員(yuan)簽(qian)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合同(tong),依法建(jian)立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)關系(xi)(xi),明確雙(shuang)方(fang)的(de)權利和(he)義務,特別是明確作(zuo)(zuo)(zuo)為(wei)勞(lao)(lao)(lao)(lao)(lao)(lao)務派(pai)遣的(de)用(yong)人(ren)(ren)(ren)單位(wei)及(ji)工(gong)種(zhong)崗位(wei)、工(gong)作(zuo)(zuo)(zuo)時(shi)間、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)報(bao)酬(chou)及(ji)工(gong)資支付方(fang)式,參(can)加社(she)會(hui)保(bao)險(xian)等,并在當(dang)地(di)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)障部門(men)辦(ban)理相關的(de)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)用(yong)工(gong)、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合同(tong)簽(qian)訂(ding)證和(he)社(she)會(hui)保(bao)險(xian)登記、申(shen)報(bao)、繳(jiao)費手續。勞(lao)(lao)(lao)(lao)(lao)(lao)務型公司在進行勞(lao)(lao)(lao)(lao)(lao)(lao)務派(pai)遣時(shi),還(huan)必(bi)須(xu)與(yu)企事業(ye)用(yong)人(ren)(ren)(ren)單位(wei)簽(qian)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)務協議,依法建(jian)立勞(lao)(lao)(lao)(lao)(lao)(lao)務派(pai)遣與(yu)使用(yong)關系(xi)(xi),明確勞(lao)(lao)(lao)(lao)(lao)(lao)務派(pai)遣人(ren)(ren)(ren)員(yuan)的(de)工(gong)作(zuo)(zuo)(zuo)崗位(wei)、工(gong)作(zuo)(zuo)(zuo)時(shi)間、勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)報(bao)酬(chou)標準,以及(ji)社(she)會(hui)保(bao)險(xian)費結付標準和(he)繳(jiao)納(na)辦(ban)法。可以說,勞(lao)(lao)(lao)(lao)(lao)(lao)務型公司與(yu)勞(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)(ren)(ren)員(yuan)簽(qian)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合同(tong)、與(yu)用(yong)人(ren)(ren)(ren)單位(wei)簽(qian)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)務合同(tong),是依法規范用(yong)工(gong)、避免(mian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)爭(zheng)議和(he)勞(lao)(lao)(lao)(lao)(lao)(lao)務糾(jiu)紛的(de)最重要(yao)的(de)基礎工(gong)作(zuo)(zuo)(zuo)。
