一 、雇員租賃原則

勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian)的(de)(de)(de)本質是雇員租(zu)(zu)(zu)賃(lin),“派(pai)遣(qian)(qian)(qian)”一詞(ci)并(bing)(bing)不適用(yong)于(yu)解釋(shi)勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian)經營(ying)活動的(de)(de)(de)法律(lv)關系和業務(wu)(wu)(wu)(wu)(wu)特(te)征(zheng)。“租(zu)(zu)(zu)賃(lin)”一詞(ci)卻能概(gai)括(kuo)勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian)所(suo)有業務(wu)(wu)(wu)(wu)(wu)特(te)征(zheng),并(bing)(bing)合理解讀勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian)復(fu)雜的(de)(de)(de)三方法律(lv)關系。租(zu)(zu)(zu)賃(lin)與雇傭一樣更適用(yong)于(yu)解釋(shi)勞(lao)動力與工作(zuo)單位之間的(de)(de)(de)法。 以勞(lao)務(wu)(wu)(wu)(wu)(wu)承包(bao)為特(te)征(zheng)的(de)(de)(de)勞(lao)務(wu)(wu)(wu)(wu)(wu)外包(bao)合作(zuo),因為不存在租(zu)(zu)(zu)賃(lin)關系而并(bing)(bing)非勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian),也不適宜簽訂(ding)勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)(qian)(qian)合同(tong)。

二、同工同酬原則

現(xian)行(xing)法律制(zhi)度(du)規定勞(lao)務派遣(qian)用工(gong)(gong)(gong)(gong)單位(wei),應(ying)(ying)當(dang)實行(xing)同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)制(zhi)度(du),讓派遣(qian)員工(gong)(gong)(gong)(gong)與企業自身員工(gong)(gong)(gong)(gong)享受(shou)完全相同(tong)(tong)(tong)(tong)的工(gong)(gong)(gong)(gong)資和福利待遇(yu)。同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)可以簡(jian)單地(di)理(li)解為,相同(tong)(tong)(tong)(tong)崗位(wei)、相同(tong)(tong)(tong)(tong)等級的員工(gong)(gong)(gong)(gong),應(ying)(ying)該執行(xing)同(tong)(tong)(tong)(tong)等工(gong)(gong)(gong)(gong)資待遇(yu)標準(zhun)。但這樣(yang)就(jiu)容易被異化為,用工(gong)(gong)(gong)(gong)單位(wei)應(ying)(ying)對(dui)同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)的一種對(dui)策。

三、拒絕墊付原則

現(xian)行法律制度明確了(le)勞(lao)務派(pai)遣(qian)(qian)三方(fang)法律關系中,用(yong)(yong)工(gong)單位(wei)應當實(shi)際承擔派(pai)遣(qian)(qian)員工(gong)工(gong)資和(he)社保費(fei)用(yong)(yong)。這(zhe)就是勞(lao)務派(pai)遣(qian)(qian)公司不墊付(fu)原(yuan)則的法律基礎(chu),也就是說派(pai)遣(qian)(qian)公司不為用(yong)(yong)工(gong)單位(wei)墊付(fu)派(pai)遣(qian)(qian)員工(gong)工(gong)資和(he)社保費(fei)用(yong)(yong)。一(yi)旦派(pai)遣(qian)(qian)公司不能堅持原(yuan)則,為用(yong)(yong)工(gong)單位(wei)墊付(fu)上述費(fei)用(yong)(yong),也就意味(wei)著無形中極大地增加自(zi)身的經營風險。

四、受益歸責原則

《侵(qin)(qin)權責(ze)任法(fa)》規(gui)定:“派(pai)遣員(yuan)工(gong)(gong)(gong)(gong)因執行工(gong)(gong)(gong)(gong)作任務(wu)(wu)(wu)造成他人損害(hai)的,由接受(shou)勞務(wu)(wu)(wu)派(pai)遣的用(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)承擔侵(qin)(qin)權責(ze)任;勞務(wu)(wu)(wu)派(pai)遣單(dan)位(wei)有(you)過錯的,承擔相應的補充責(ze)任。”“誰(shui)(shui)(shui)用(yong)(yong)工(gong)(gong)(gong)(gong),誰(shui)(shui)(shui)受(shou)益”是一種(zhong)普(pu)通常識,“誰(shui)(shui)(shui)受(shou)益,誰(shui)(shui)(shui)擔責(ze)”則是利(li)益義務(wu)(wu)(wu)對等的基本原則。派(pai)遣員(yuan)工(gong)(gong)(gong)(gong)一旦出現工(gong)(gong)(gong)(gong)傷事故(gu),工(gong)(gong)(gong)(gong)傷保險待遇賠(pei)償不足部(bu)分則應有(you)真正用(yong)(yong)工(gong)(gong)(gong)(gong)受(shou)益方即用(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)負(fu)責(ze)承擔。
