勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務派遣(qian)中的(de)(de)(de)問(wen)題,主要有(you)(you):一是(shi)(shi)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系(xi)(xi)不(bu)(bu)(bu)清晰。勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型公(gong)(gong)司與用(yong)人(ren)單(dan)(dan)位簽訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務派遣(qian)協議(yi),用(yong)人(ren)單(dan)(dan)位不(bu)(bu)(bu)直接與勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)(zhe)簽訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動合(he)同,造成勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)(zhe)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系(xi)(xi)和(he)工(gong)(gong)(gong)(gong)(gong)作(zuo)崗位分(fen)(fen)別屬(shu)(shu)于(yu)兩(liang)家(jia)(jia)(jia)單(dan)(dan)位的(de)(de)(de)情況(kuang)。二是(shi)(shi)工(gong)(gong)(gong)(gong)(gong)資(zi)支付(fu)不(bu)(bu)(bu)透明。由于(yu)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)(zhe)的(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動關(guan)系(xi)(xi)和(he)工(gong)(gong)(gong)(gong)(gong)作(zuo)崗位分(fen)(fen)屬(shu)(shu)兩(liang)家(jia)(jia)(jia),出現部分(fen)(fen)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型企(qi)(qi)業(ye)(ye)及用(yong)人(ren)單(dan)(dan)位隨(sui)意(yi)克扣工(gong)(gong)(gong)(gong)(gong)資(zi),不(bu)(bu)(bu)按月發放工(gong)(gong)(gong)(gong)(gong)資(zi)、不(bu)(bu)(bu)按規(gui)(gui)定結付(fu)加班工(gong)(gong)(gong)(gong)(gong)資(zi)等(deng)情況(kuang),勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)(zhe)的(de)(de)(de)權(quan)益(yi)受(shou)侵害后責任主體不(bu)(bu)(bu)明確。三是(shi)(shi)社會(hui)保(bao)險(xian)不(bu)(bu)(bu)參加。有(you)(you)的(de)(de)(de)用(yong)人(ren)單(dan)(dan)位利用(yong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務派遣(qian)用(yong)人(ren)形式,逃避社會(hui)保(bao)險(xian)義務,而勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型公(gong)(gong)司又不(bu)(bu)(bu)為(wei)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)辦理參保(bao)手續,不(bu)(bu)(bu)繳納(na)社保(bao)費(fei),或者(zhe)(zhe)(zhe)是(shi)(shi)讓勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)自己承擔繳納(na)全部的(de)(de)(de)社保(bao)費(fei)。四是(shi)(shi)同等(deng)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動不(bu)(bu)(bu)同報(bao)酬。勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)在用(yong)人(ren)單(dan)(dan)位往往成為(wei)另類,從(cong)事的(de)(de)(de)是(shi)(shi)苦、臟、累(lei)、重的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)作(zuo),報(bao)酬待遇低(di),不(bu)(bu)(bu)享受(shou)用(yong)人(ren)單(dan)(dan)位的(de)(de)(de)獎金和(he)福利等(deng)。五是(shi)(shi)工(gong)(gong)(gong)(gong)(gong)作(zuo)時間不(bu)(bu)(bu)規(gui)(gui)范(fan)。被派遣(qian)的(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)需遵(zun)守用(yong)人(ren)單(dan)(dan)位的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)作(zuo)時間,這本(ben)屬(shu)(shu)正常(chang),但有(you)(you)的(de)(de)(de)用(yong)人(ren)單(dan)(dan)位對(dui)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)任意(yi)安排(pai)加班加點,工(gong)(gong)(gong)(gong)(gong)作(zuo)時間大大超過國家(jia)(jia)(jia)規(gui)(gui)定,并且不(bu)(bu)(bu)按規(gui)(gui)定支付(fu)加班工(gong)(gong)(gong)(gong)(gong)資(zi),還(huan)把(ba)違章責任推卸給(gei)(gei)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型企(qi)(qi)業(ye)(ye)。勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型企(qi)(qi)業(ye)(ye)為(wei)與用(yong)人(ren)單(dan)(dan)位維持勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務派遣(qian)關(guan)系(xi)(xi),不(bu)(bu)(bu)敢幫勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)維權(quan)。六是(shi)(shi)員(yuan)(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)結構(gou)不(bu)(bu)(bu)合(he)理。一些(xie)經濟欠發地(di)區的(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型公(gong)(gong)司,以勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務派遣(qian)形式,大量(liang)向沿海經濟發達城市的(de)(de)(de)企(qi)(qi)業(ye)(ye)派遣(qian)“低(di)價(jia)”勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan),造成這些(xie)企(qi)(qi)業(ye)(ye)用(yong)人(ren)結構(gou)出現正式員(yuan)(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)少、勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan)多的(de)(de)(de)不(bu)(bu)(bu)正常(chang)現象。有(you)(you)的(de)(de)(de)企(qi)(qi)業(ye)(ye)甚至整(zheng)條生產線包(bao)給(gei)(gei)外(wai)地(di)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型公(gong)(gong)司,再由勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務型公(gong)(gong)司招收勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)務人(ren)員(yuan)(yuan)(yuan),采(cai)取“外(wai)包(bao)內(nei)做(zuo)”形式。以上這些(xie)問(wen)題,對(dui)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動力市場秩(zhi)序、社會(hui)保(bao)險(xian)和(he)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)動者(zhe)(zhe)(zhe)權(quan)益(yi)都產生不(bu)(bu)(bu)利的(de)(de)(de)影響。 首先,要(yao)明(ming)確規(gui)定(ding)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)的范(fan)(fan)圍。企(qi)(qi)事(shi)業(ye)(ye)單位(wei)(wei)用(yong)(yong)工(gong)(gong),應以(yi)直接招聘錄用(yong)(yong)員工(gong)(gong),并(bing)簽訂勞(lao)(lao)動(dong)合同,建立正式勞(lao)(lao)動(dong)關系,建立一支基本職工(gong)(gong)隊伍為(wei)(wei)主(zhu),而勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)作(zuo)為(wei)(wei)一種特殊的用(yong)(yong)工(gong)(gong)形(xing)式和(he)勞(lao)(lao)動(dong)關系,并(bing)不適(shi)合所(suo)有(you)企(qi)(qi)事(shi)業(ye)(ye)用(yong)(yong)人(ren)(ren)單位(wei)(wei),只適(shi)合一些特殊用(yong)(yong)人(ren)(ren)單位(wei)(wei)或特殊崗位(wei)(wei)。因(yin)此,勞(lao)(lao)動(dong)保(bao)障部(bu)門對(dui)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型(xing)公(gong)(gong)司(si)(si)進(jin)行(xing)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian),應明(ming)確規(gui)定(ding)派(pai)(pai)遣(qian)的范(fan)(fan)圍。如(ru)外地(di)企(qi)(qi)業(ye)(ye)進(jin)入當(dang)地(di)設立的非法人(ren)(ren)分支機構或當(dang)地(di)未注冊機構的所(suo)需用(yong)(yong)工(gong)(gong),因(yin)其(qi)不具法人(ren)(ren)資格而不能直接招用(yong)(yong)工(gong)(gong),與員工(gong)(gong)建立勞(lao)(lao)動(dong)關系,所(suo)以(yi)要(yao)由(you)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)型(xing)公(gong)(gong)司(si)(si)派(pai)(pai)遣(qian)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)員供其(qi)使(shi)用(yong)(yong)。再如(ru),企(qi)(qi)業(ye)(ye)的保(bao)安(an)、保(bao)潔、綠化養護(hu)等特殊崗位(wei)(wei)用(yong)(yong)人(ren)(ren),銀行(xing)、保(bao)險(xian)公(gong)(gong)司(si)(si)因(yin)編制所(suo)限需使(shi)用(yong)(yong)編外人(ren)(ren)員,也可由(you)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)公(gong)(gong)司(si)(si)派(pai)(pai)遣(qian)勞(lao)(lao)務(wu)(wu)(wu)(wu)(wu)人(ren)(ren)員。 其次,要(yao)(yao)依法(fa)(fa)簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)動(dong)合(he)同(tong)和(he)勞(lao)(lao)(lao)務(wu)(wu)合(he)同(tong)。作(zuo)(zuo)為(wei)具有法(fa)(fa)人資格的(de)(de)(de)(de)勞(lao)(lao)(lao)務(wu)(wu)型(xing)(xing)企(qi)業(ye),應與(yu)招聘錄(lu)用(yong)(yong)的(de)(de)(de)(de)勞(lao)(lao)(lao)務(wu)(wu)人員簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)動(dong)合(he)同(tong),依法(fa)(fa)建立(li)勞(lao)(lao)(lao)動(dong)關系,明(ming)確(que)雙方的(de)(de)(de)(de)權利和(he)義(yi)務(wu)(wu),特(te)別是明(ming)確(que)作(zuo)(zuo)為(wei)勞(lao)(lao)(lao)務(wu)(wu)派(pai)遣(qian)的(de)(de)(de)(de)用(yong)(yong)人單位(wei)及工(gong)(gong)種崗位(wei)、工(gong)(gong)作(zuo)(zuo)時間、勞(lao)(lao)(lao)動(dong)報酬及工(gong)(gong)資支付方式,參加社(she)(she)會保險等,并在當(dang)地(di)勞(lao)(lao)(lao)動(dong)保障(zhang)部門辦理相關的(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)用(yong)(yong)工(gong)(gong)、勞(lao)(lao)(lao)動(dong)合(he)同(tong)簽(qian)訂(ding)(ding)證和(he)社(she)(she)會保險登記、申報、繳費手續。勞(lao)(lao)(lao)務(wu)(wu)型(xing)(xing)公(gong)司在進行勞(lao)(lao)(lao)務(wu)(wu)派(pai)遣(qian)時,還必須(xu)與(yu)企(qi)事業(ye)用(yong)(yong)人單位(wei)簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)務(wu)(wu)協議(yi),依法(fa)(fa)建立(li)勞(lao)(lao)(lao)務(wu)(wu)派(pai)遣(qian)與(yu)使用(yong)(yong)關系,明(ming)確(que)勞(lao)(lao)(lao)務(wu)(wu)派(pai)遣(qian)人員的(de)(de)(de)(de)工(gong)(gong)作(zuo)(zuo)崗位(wei)、工(gong)(gong)作(zuo)(zuo)時間、勞(lao)(lao)(lao)動(dong)報酬標(biao)準,以(yi)及社(she)(she)會保險費結付標(biao)準和(he)繳納辦法(fa)(fa)。可以(yi)說,勞(lao)(lao)(lao)務(wu)(wu)型(xing)(xing)公(gong)司與(yu)勞(lao)(lao)(lao)務(wu)(wu)人員簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)動(dong)合(he)同(tong)、與(yu)用(yong)(yong)人單位(wei)簽(qian)訂(ding)(ding)勞(lao)(lao)(lao)務(wu)(wu)合(he)同(tong),是依法(fa)(fa)規(gui)范用(yong)(yong)工(gong)(gong)、避免(mian)勞(lao)(lao)(lao)動(dong)爭(zheng)議(yi)和(he)勞(lao)(lao)(lao)務(wu)(wu)糾紛的(de)(de)(de)(de)最(zui)重要(yao)(yao)的(de)(de)(de)(de)基礎工(gong)(gong)作(zuo)(zuo)。
