勞務派遣概念發表(biao)時間:2019-07-26 11:18 根(gen)據《中華人民共和國(guo)勞(lao)動(dong)合同法(fa)》(以(yi)下(xia)簡稱“《勞(lao)動(dong)合同法(fa)》”)的規定,勞(lao)務(wu)派(pai)遣是(shi)指勞(lao)務(wu)派(pai)遣機構與用(yong)(yong)工(gong)單位簽訂勞(lao)務(wu)派(pai)遣協(xie)議,將勞(lao)動(dong)者派(pai)遣至(zhi)用(yong)(yong)工(gong)單位工(gong)作。 勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)法(fa)律關系涉及(ji)兩份合(he)同(tong)(tong)/協議,即勞(lao)(lao)(lao)動(dong)(dong)者與勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)單(dan)位(wei)簽訂(ding)的(de)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong),以及(ji)勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)公司與用人(ren)單(dan)位(wei)簽訂(ding)的(de)勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)協議。前(qian)者適用《勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》前(qian)四章的(de)基本規定,以及(ji)“勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)”這一節有關勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)固定期限以及(ji)勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬(chou)的(de)規定。 后者則適用(yong)《勞(lao)動(dong)合同法》有關(guan)勞(lao)務派遣單(dan)位(wei)設立條件(jian)、勞(lao)務派遣協議內容等(deng)有關(guan)規定。 為了防范企業通過勞(lao)務(wu)派(pai)(pai)遣(qian)形式損害勞(lao)動者(zhe)的合(he)法(fa)權益,規避相關的法(fa)律法(fa)規,《勞(lao)動合(he)同法(fa)》對勞(lao)務(wu)派(pai)(pai)遣(qian)崗(gang)位(wei)特點(dian)、勞(lao)務(wu)派(pai)(pai)遣(qian)用工數量(liang)進(jin)行了限(xian)制(zhi),并且嚴禁用工單(dan)(dan)(dan)(dan)位(wei)通過自設勞(lao)務(wu)派(pai)(pai)遣(qian)單(dan)(dan)(dan)(dan)位(wei)的形式來向本單(dan)(dan)(dan)(dan)位(wei)或者(zhe)數所單(dan)(dan)(dan)(dan)位(wei)派(pai)(pai)遣(qian)勞(lao)動者(zhe)。 下(xia)一篇(pian)勞務外包與勞務派遣的區別
