A公(gong)司(si)主要從事(shi)(shi)床上(shang)用(yong)品(pin)的(de)(de)生產(chan)、銷(xiao)售,生產(chan)季(ji)(ji)節(jie)性較(jiao)強,每(mei)年7月(yue)至9月(yue)是(shi)生產(chan)旺季(ji)(ji)。貴州勞(lao)(lao)(lao)務(wu)派遣(qian)現(xian)在(zai)有(you)一種(zhong)‘逆向派遣(qian)’的(de)(de)怪象,一些用(yong)人(ren)單(dan)位(wei)在(zai)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同法實施后(hou),要求(qiu)(qiu)正式合(he)同工(gong)(gong)與勞(lao)(lao)(lao)務(wu)公(gong)司(si)簽訂派遣(qian)合(he)同轉(zhuan)為勞(lao)(lao)(lao)務(wu)派遣(qian)工(gong)(gong),再派回(hui)到原來的(de)(de)工(gong)(gong)作(zuo)(zuo)(zuo)崗位(wei)上(shang)去。勞(lao)(lao)(lao)務(wu)派遣(qian)已經成為部(bu)分用(yong)人(ren)單(dan)位(wei)規避《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同法》規定(ding)(ding)的(de)(de)用(yong)人(ren)單(dan)位(wei)責任的(de)(de)一種(zhong)途徑。朱(zhu)某(mou)(mou)自(zi)2001年以(yi)來,每(mei)逢生產(chan)旺季(ji)(ji),自(zi)帶其(qi)本人(ren)的(de)(de)小貨(huo)車至該公(gong)司(si)從事(shi)(shi)運輸(shu)等工(gong)(gong)作(zuo)(zuo)(zuo)。雙方約定(ding)(ding)A公(gong)司(si)每(mei)月(yue)支(zhi)付(fu)朱(zhu)某(mou)(mou)報酬(reward)2000元,油費、過路費、違章罰款等費用(yong)均由A公(gong)司(si)支(zhi)付(fu)。期(qi)間(jian),朱(zhu)某(mou)(mou)日常生活起居(ju)均在(zai)公(gong)司(si)內。某(mou)(mou)日,朱(zhu)某(mou)(mou)受(shou)A公(gong)司(si)指派在(zai)購買發動(dong)(dong)(dong)機(Engine)途中發生交通(tong)事(shi)(shi)故死亡。朱(zhu)某(mou)(mou)之(zhi)妻(qi)向當地(di)勞(lao)(lao)(lao)動(dong)(dong)(dong)保障部(bu)門申請(qing)工(gong)(gong)傷認(ren)定(ding)(ding)。勞(lao)(lao)(lao)動(dong)(dong)(dong)部(bu)門審查(cha)后(hou)認(ren)為朱(zhu)某(mou)(mou)自(zi)備(bei)勞(lao)(lao)(lao)動(dong)(dong)(dong)工(gong)(gong)具為A公(gong)司(si)提供勞(lao)(lao)(lao)動(dong)(dong)(dong)服務(wu),具有(you)臨時(shi)性、短期(qi)性的(de)(de)特點,且(qie)雙方不(bu)存在(zai)管理與被管理的(de)(de)社會關(guan)系。遂作(zuo)(zuo)(zuo)出工(gong)(gong)傷調查(cha)結(jie)論,認(ren)定(ding)(ding)朱(zhu)某(mou)(mou)與A公(gong)司(si)之(zhi)間(jian)是(shi)勞(lao)(lao)(lao)務(wu)關(guan)系而非勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系,不(bu)屬于該局管轄范(fan)圍(wei)(fàn wéi)。朱(zhu)某(mou)(mou)之(zhi)妻(qi)不(bu)服,起訴(su)至法院,請(qing)求(qiu)(qiu)依(yi)法撤銷(xiao)勞(lao)(lao)(lao)動(dong)(dong)(dong)部(bu)門作(zuo)(zuo)(zuo)出的(de)(de)工(gong)(gong)傷調查(cha)結(jie)論。法院受(shou)理后(hou),因A公(gong)司(si)于該案(an)有(you)利(li)害關(guan)系,依(yi)法追加A公(gong)司(si)為第(di)三人(ren)參加訴(su)訟(song)。 [爭議焦(jiao)點(dian)] 從表面上(shang)看,這是(shi)(shi)共同普通的(de)(de)工(gong)傷認(ren)(ren)定(ding)案件,但案件的(de)(de)焦(jiao)點卻是(shi)(shi)朱某(mou)與(yu)(yu)A公司(si)之間(jian)(jian)究(jiu)竟是(shi)(shi)勞動關(guan)系(xi)(xi)還是(shi)(shi)勞務關(guan)系(xi)(xi)。如(ru)果確認(ren)(ren)朱某(mou)與(yu)(yu)A公司(si)之間(jian)(jian)存在勞動關(guan)系(xi)(xi),朱某(mou)之死應被(bei)認(ren)(ren)定(ding)為工(gong)傷,朱某(mou)之妻就能依法享受工(gong)傷待(dai)遇(yu)(yu);如(ru)果確認(ren)(ren)朱某(mou)與(yu)(yu)A公司(si)之間(jian)(jian)是(shi)(shi)勞務關(guan)系(xi)(xi),朱某(mou)之妻只能尋求民事賠償。工(gong)傷待(dai)遇(yu)(yu)與(yu)(yu)民事賠償是(shi)(shi)兩種不(bu)同的(de)(de)責任(zé rèn)形(xing)式,承擔方式與(yu)(yu)待(dai)遇(yu)(yu)水平相差較大。由此可見,對(dui)勞動關(guan)系(xi)(xi)與(yu)(yu)勞務關(guan)系(xi)(xi)的(de)(de)不(bu)同確認(ren)(ren)結果直接關(guan)系(xi)(xi)著(zhu)當事人的(de)(de)利(li)益(yi)(benefit)。 在(zai)本(ben)案庭審過程(guò chéng)中,圍繞(rao)著朱某與A公(gong)司(si)(Company)之間究竟是(shi)勞(lao)動(dong)關系還(huan)是(shi)勞(lao)務關系這一(yi)焦點問(wen)題(Emerson),當事人各執一(yi)詞,并形成如下對抗意(yi)見: 1.朱某(mou)(mou)自備(bei)勞(lao)(lao)(lao)動(dong)(dong)(dong)工(gong)具是(shi)(shi)否影響(influence)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)的(de)成立原告認(ren)(ren)(ren)為(wei)朱某(mou)(mou)雖然自備(bei)車(che)輛(liang),但是(shi)(shi)開(kai)車(che)所(suo)需(xu)的(de)油費(fei)(fei)、過路費(fei)(fei)甚至違章罰(fa)款費(fei)(fei)都由(you)A公司承(cheng)擔。如果朱某(mou)(mou)是(shi)(shi)搞(gao)個體運輸的(de),那(nei)么上述費(fei)(fei)用開(kai)支由(you)A公司承(cheng)擔顯(xian)然不(bu)符合(he)邏輯(ji)。因此(ci),合(he)理(li)解釋是(shi)(shi)朱某(mou)(mou)所(suo)有的(de)機動(dong)(dong)(dong)車(che)與A公司的(de)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)屬(shu)租賃關(guan)(guan)(guan)系(xi)(xi)(xi)(xi),而朱某(mou)(mou)與A公司的(de)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)屬(shu)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)。被(bei)告則(ze)認(ren)(ren)(ren)為(wei)朱某(mou)(mou)自備(bei)勞(lao)(lao)(lao)動(dong)(dong)(dong)工(gong)具是(shi)(shi)為(wei)A公司提供(gong)勞(lao)(lao)(lao)動(dong)(dong)(dong)服(fu)務(wu)。第三人A公司認(ren)(ren)(ren)為(wei),在勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)里(li),生產工(gong)具是(shi)(shi)由(you)用人單(dan)位提供(gong)的(de);而在勞(lao)(lao)(lao)務(wu)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)里(li),生產工(gong)具則(ze)是(shi)(shi)由(you)勞(lao)(lao)(lao)動(dong)(dong)(dong)者自己提供(gong)的(de)。朱某(mou)(mou)自備(bei)小貨車(che)為(wei)A公司提供(gong)運輸服(fu)務(wu),二者之(zhi)間不(bu)是(shi)(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi),而是(shi)(shi)勞(lao)(lao)(lao)務(wu)關(guan)(guan)(guan)系(xi)(xi)(xi)(xi)。 2.朱某與(yu)A公(gong)司(Company)之間(jian)(jian)(jian)的(de)關(guan)(guan)系是否具(ju)(ju)有(you)(you)臨(lin)(lin)時性(xing)、短期(qi)性(xing)的(de)特(te)性(xing)?被告及第三人(ren)認(ren)為(wei)(wei)由于A公(gong)司從事的(de)生(sheng)產具(ju)(ju)有(you)(you)明顯的(de)季節性(xing),每年生(sheng)產的(de)時間(jian)(jian)(jian)也就是2-3個(ge)(ge)月。在此情況下,朱某為(wei)(wei)其(qi)提供運輸服務具(ju)(ju)有(you)(you)短期(qi)性(xing)、臨(lin)(lin)時性(xing)的(de)特(te)點,這符(fu)合(he)勞(lao)(lao)務關(guan)(guan)系的(de)特(te)點,而勞(lao)(lao)動關(guan)(guan)系一般比較穩定,時間(jian)(jian)(jian)較長(chang),試用期(qi)都會有(you)(you)3個(ge)(ge)月。原(yuan)告認(ren)為(wei)(wei),上(shang)述認(ren)定具(ju)(ju)有(you)(you)主觀臆(yi)測性(xing),難以維護眾多臨(lin)(lin)時打工者(zhe)的(de)合(he)法權益,而且A公(gong)司的(de)生(sheng)產季節性(xing)強,使得勞(lao)(lao)動者(zhe)不可能長(chang)期(qi)提供勞(lao)(lao)動。 3.A公(gong)司(si)(si)(si)(Company)與(yu)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)之間(jian)(jian)是(shi)否存(cun)(cun)在(zai)(zai)管(guan)理(li)(li)與(yu)被(bei)管(guan)理(li)(li)關系(xi)?被(bei)告(gao)及第三人認為(wei),證據(ju)表明(ming)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)用車以(yi)外的(de)時間(jian)(jian)由朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)自由支配(包括為(wei)其他人提(ti)供運(yun)輸服務),不(bu)受(shou)原(yuan)告(gao)規章制度(du)的(de)約束。因(yin)此,A公(gong)司(si)(si)(si)與(yu)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)不(bu)存(cun)(cun)在(zai)(zai)管(guan)理(li)(li)與(yu)被(bei)管(guan)理(li)(li)關系(xi)。原(yuan)告(gao)則認為(wei)在(zai)(zai)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)為(wei)A公(gong)司(si)(si)(si)工(gong)作期間(jian)(jian),其日常生活起居均在(zai)(zai)公(gong)司(si)(si)(si),A公(gong)司(si)(si)(si)免(mian)費為(wei)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)提(ti)供吃住并每月支付朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)工(gong)資2000元,而且有證據(ju)表明(ming)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)除承擔運(yun)輸工(gong)作外,還受(shou)相關主管(guan)人員指派從事縫紉機的(de)修(xiu)理(li)(li)等工(gong)作。至于朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)在(zai)(zai)公(gong)司(si)(si)(si)比較自由,是(shi)由于公(gong)司(si)(si)(si)沒有健全公(gong)司(si)(si)(si)的(de)內部管(guan)理(li)(li)制度(du)(Management system),不(bu)能因(yin)此否認A公(gong)司(si)(si)(si)與(yu)朱(zhu)(zhu)(zhu)(zhu)某(mou)(mou)之間(jian)(jian)存(cun)(cun)在(zai)(zai)管(guan)理(li)(li)與(yu)被(bei)管(guan)理(li)(li)關系(xi)。 [法院(yuan)審理] 法(fa)(fa)院審理(li)(li)后(hou)認(ren)(ren)(ren)為(wei)(wei)(wei),本案訴爭(zheng)的(de)(de)(de)(de)是(shi)被(bei)告工(gong)(gong)(gong)傷調(diao)查結(jie)論的(de)(de)(de)(de)具(ju)(ju)體(ti)行(xing)(xing)政(zheng)行(xing)(xing)為(wei)(wei)(wei),被(bei)告作為(wei)(wei)(wei)勞(lao)(lao)動(dong)(dong)保障(起保障作用的(de)(de)(de)(de)事物(wu))行(xing)(xing)政(zheng)管(guan)理(li)(li)(public administration)部門(men),在(zai)其(qi)職權范圍內(nei),根據原(yuan)(yuan)告的(de)(de)(de)(de)申(shen)請,對(dui)原(yuan)(yuan)告之夫朱某的(de)(de)(de)(de)死亡(wang)是(shi)否屬(shu)于工(gong)(gong)(gong)傷作出認(ren)(ren)(ren)定(ding)是(shi)其(qi)法(fa)(fa)定(ding)職責。工(gong)(gong)(gong)傷認(ren)(ren)(ren)定(ding)的(de)(de)(de)(de)前提是(shi)勞(lao)(lao)動(dong)(dong)者與(yu)用人(ren)單位成(cheng)立(li)具(ju)(ju)有管(guan)理(li)(li)性質(zhi)的(de)(de)(de)(de)勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)(xi)。本案中,第三人(ren)A公(gong)(gong)司(si)主要從事床上用品的(de)(de)(de)(de)生產、銷(xiao)售(shou),生產季節性較強,主要集中在(zai)每年7月至9月,其(qi)特殊性使(shi)得勞(lao)(lao)動(dong)(dong)者不(bu)(bu)(bu)可能長期(qi)不(bu)(bu)(bu)間(jian)斷地為(wei)(wei)(wei)其(qi)提供(gong)勞(lao)(lao)動(dong)(dong)力(li)。且勞(lao)(lao)動(dong)(dong)者提供(gong)勞(lao)(lao)動(dong)(dong)的(de)(de)(de)(de)形式也具(ju)(ju)有多樣(yang)性。朱某自備生產工(gong)(gong)(gong)具(ju)(ju)在(zai)該公(gong)(gong)司(si)從事運輸等工(gong)(gong)(gong)作期(qi)間(jian),有固定(ding)的(de)(de)(de)(de)月收入,車輛的(de)(de)(de)(de)相關(guan)(guan)(related)費用(expense)也由(you)(you)公(gong)(gong)司(si)承(cheng)擔,顯然雙方(fang)(fang)具(ju)(ju)有一定(ding)的(de)(de)(de)(de)管(guan)理(li)(li)與(yu)被(bei)管(guan)理(li)(li)關(guan)(guan)系(xi)(xi)。朱某工(gong)(gong)(gong)作之余較為(wei)(wei)(wei)自由(you)(you),也未與(yu)公(gong)(gong)司(si)簽訂書(shu)面的(de)(de)(de)(de)勞(lao)(lao)動(dong)(dong)合(he)同(tong),這是(shi)該公(gong)(gong)司(si)自身尚未健(jian)全內(nei)部管(guan)理(li)(li)及勞(lao)(lao)動(dong)(dong)保障制度的(de)(de)(de)(de)結(jie)果,不(bu)(bu)(bu)影(ying)響(xiang)雙方(fang)(fang)事實(shi)(Fact)勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)(xi)的(de)(de)(de)(de)成(cheng)立(li)。被(bei)告認(ren)(ren)(ren)定(ding)朱某與(yu)A公(gong)(gong)司(si)不(bu)(bu)(bu)存在(zai)勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)(xi)、朱某死亡(wang)不(bu)(bu)(bu)屬(shu)于其(qi)管(guan)轄范圍的(de)(de)(de)(de)證(zheng)據尚不(bu)(bu)(bu)能達(da)到清楚而有說服力(li)的(de)(de)(de)(de)證(zheng)明標準,其(qi)作出的(de)(de)(de)(de)工(gong)(gong)(gong)傷調(diao)查結(jie)論屬(shu)認(ren)(ren)(ren)定(ding)事實(shi)錯誤。遂(sui)作出判(pan)決,撤銷(xiao)勞(lao)(lao)動(dong)(dong)部門(men)作出的(de)(de)(de)(de)工(gong)(gong)(gong)傷調(diao)查結(jie)論,并責令其(qi)在(zai)判(pan)決生效(xiao)后(hou)一個月內(nei)重新作出具(ju)(ju)體(ti)行(xing)(xing)政(zheng)行(xing)(xing)為(wei)(wei)(wei)。 chǎng)愈加活躍,用(yong)人形式也更為(wei)靈活多(duo)樣,新型勞(lao)動關(guan)(guan)系大量出現,并且勞(lao)動關(guan)(guan)系與(yu)勞(lao)務(wu)關(guan)(guan)系的(de)客(ke)觀特征正在逐(zhu)步(bu)(step by step)模糊。 如在(zai)本案中,朱(zhu)某與A公(gong)司似乎(hu)形成勞(lao)務關系,因為: 1.朱某(mou)自(zi)備車輛為A公(gong)司(Company)提(ti)供(gong)運輸。一般勞動關系中(zhong),生產(chan)(Produce)工(gong)具是(shi)用人單位(wei)(unit)提(ti)供(gong)的,而(er)勞務(wu)關系里,生產(chan)工(gong)具通常(chang)是(shi)服務(wu)方自(zi)己提(ti)供(gong)的。 2.朱某只在(zai)每年7月至(zhi)9月的(de)生產(chan)(chan)旺季(產(chan)(chan)品(pin)產(chan)(chan)量、銷售量增加的(de)時期(qi)或(huo)時節)階(jie)段進入A公司(si)(Company)工作,似(si)乎(hu)符合勞(lao)務關系“臨時性(xing)、短期(qi)性(xing)”的(de)特點。 3.A公(gong)司(si)對朱某(mou)上下班的(de)時(shi)間(jian)沒有明(ming)確規定(guī dìng),用車以外(wai)的(de)時(shi)間(jian)自(zi)由(you)支配度較(jiao)大(da),與一(yi)(yi)般(ban)勞(lao)動(dong)關系中(zhong)用人單位(unit)與勞(lao)動(dong)者(zhe)之間(jian)嚴格的(de)管(guan)理與被管(guan)理關系有一(yi)(yi)定程度的(de)差(cha)異。貴州勞(lao)務外(wai)包(bao)為(wei)(wei)外(wai)包(bao)已(yi)經成(cheng)(cheng)為(wei)(wei)一(yi)(yi)個(ge)(ge)獨立于企業(ye)之外(wai)的(de)過程,而且許多基礎數據都已(yi)經不在(zai)企業(ye)內部(bu),這樣導致了一(yi)(yi)個(ge)(ge)嚴峻的(de)現(xian)實問題:如何將(jiang)生產外(wai)包(bao)作為(wei)(wei)一(yi)(yi)個(ge)(ge)獨立過程而仍將(jiang)成(cheng)(cheng)為(wei)(wei)企業(ye)整(zheng)體流程管(guan)理的(de)一(yi)(yi)部(bu)分,這將(jiang)是管(guan)理生產外(wai)包(bao)的(de)核心(xin)。
