A公(gong)(gong)(gong)司(si)(si)(si)主(zhu)要從事床上(shang)用(yong)品的(de)(de)(de)(de)生產(chan)(chan)、銷(xiao)售,生產(chan)(chan)季節性(xing)較強(qiang),每年7月(yue)至9月(yue)是生產(chan)(chan)旺季。貴(gui)州勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)現(xian)在有(you)一種(zhong)‘逆向派(pai)(pai)遣(qian)’的(de)(de)(de)(de)怪(guai)象,一些用(yong)人(ren)單(dan)(dan)位在勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)法實施后(hou),要求正式合(he)(he)同(tong)工(gong)與勞(lao)(lao)(lao)務(wu)公(gong)(gong)(gong)司(si)(si)(si)簽(qian)訂(ding)派(pai)(pai)遣(qian)合(he)(he)同(tong)轉為(wei)(wei)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)工(gong),再派(pai)(pai)回到原來的(de)(de)(de)(de)工(gong)作崗位上(shang)去。勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)已(yi)經(jing)成為(wei)(wei)部分用(yong)人(ren)單(dan)(dan)位規避《勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)法》規定(ding)的(de)(de)(de)(de)用(yong)人(ren)單(dan)(dan)位責任的(de)(de)(de)(de)一種(zhong)途徑(jing)。朱某(mou)自2001年以來,每逢生產(chan)(chan)旺季,自帶其本人(ren)的(de)(de)(de)(de)小貨(huo)車至該(gai)公(gong)(gong)(gong)司(si)(si)(si)從事運(yun)輸等工(gong)作。雙(shuang)方約定(ding)A公(gong)(gong)(gong)司(si)(si)(si)每月(yue)支(zhi)(zhi)付朱某(mou)報酬(reward)2000元,油費、過路費、違章罰(fa)款等費用(yong)均由A公(gong)(gong)(gong)司(si)(si)(si)支(zhi)(zhi)付。期間,朱某(mou)日常生活起(qi)居均在公(gong)(gong)(gong)司(si)(si)(si)內(nei)。某(mou)日,朱某(mou)受A公(gong)(gong)(gong)司(si)(si)(si)指(zhi)派(pai)(pai)在購買發(fa)動(dong)機(ji)(Engine)途中發(fa)生交通事故死亡。朱某(mou)之(zhi)妻向當(dang)地勞(lao)(lao)(lao)動(dong)保(bao)障部門(men)申請工(gong)傷認定(ding)。勞(lao)(lao)(lao)動(dong)部門(men)審查后(hou)認為(wei)(wei)朱某(mou)自備勞(lao)(lao)(lao)動(dong)工(gong)具為(wei)(wei)A公(gong)(gong)(gong)司(si)(si)(si)提供勞(lao)(lao)(lao)動(dong)服務(wu),具有(you)臨時性(xing)、短(duan)期性(xing)的(de)(de)(de)(de)特點(dian),且雙(shuang)方不(bu)存(cun)在管理與被管理的(de)(de)(de)(de)社會(hui)關(guan)系。遂作出(chu)(chu)工(gong)傷調查結論,認定(ding)朱某(mou)與A公(gong)(gong)(gong)司(si)(si)(si)之(zhi)間是勞(lao)(lao)(lao)務(wu)關(guan)系而非勞(lao)(lao)(lao)動(dong)關(guan)系,不(bu)屬于該(gai)局管轄范圍(fàn wéi)。朱某(mou)之(zhi)妻不(bu)服,起(qi)訴(su)至法院,請求依法撤銷(xiao)勞(lao)(lao)(lao)動(dong)部門(men)作出(chu)(chu)的(de)(de)(de)(de)工(gong)傷調查結論。法院受理后(hou),因A公(gong)(gong)(gong)司(si)(si)(si)于該(gai)案(an)有(you)利害關(guan)系,依法追(zhui)加(jia)A公(gong)(gong)(gong)司(si)(si)(si)為(wei)(wei)第三人(ren)參加(jia)訴(su)訟。

[爭(zheng)議(yi)焦點]

從表面上看,這(zhe)是(shi)(shi)共同(tong)普通的(de)工傷(shang)(shang)認(ren)(ren)定(ding)案件,但案件的(de)焦點(dian)卻是(shi)(shi)朱(zhu)某(mou)與(yu)(yu)(yu)A公(gong)司(si)之(zhi)間究竟是(shi)(shi)勞動(dong)關(guan)(guan)系還是(shi)(shi)勞務關(guan)(guan)系。如果(guo)確(que)認(ren)(ren)朱(zhu)某(mou)與(yu)(yu)(yu)A公(gong)司(si)之(zhi)間存在勞動(dong)關(guan)(guan)系,朱(zhu)某(mou)之(zhi)死應被認(ren)(ren)定(ding)為工傷(shang)(shang),朱(zhu)某(mou)之(zhi)妻就能依法(fa)享受工傷(shang)(shang)待(dai)遇(yu);如果(guo)確(que)認(ren)(ren)朱(zhu)某(mou)與(yu)(yu)(yu)A公(gong)司(si)之(zhi)間是(shi)(shi)勞務關(guan)(guan)系,朱(zhu)某(mou)之(zhi)妻只能尋(xun)求民事(shi)賠償(chang)。工傷(shang)(shang)待(dai)遇(yu)與(yu)(yu)(yu)民事(shi)賠償(chang)是(shi)(shi)兩種不同(tong)的(de)責(ze)任(zé rèn)形式,承擔方式與(yu)(yu)(yu)待(dai)遇(yu)水平相差較大。由此可見,對勞動(dong)關(guan)(guan)系與(yu)(yu)(yu)勞務關(guan)(guan)系的(de)不同(tong)確(que)認(ren)(ren)結果(guo)直(zhi)接(jie)關(guan)(guan)系著(zhu)當事(shi)人的(de)利益(benefit)。

在本案庭審過程(guò chéng)中,圍繞著朱某與A公司(Company)之間究竟是勞動關(guan)系還是勞務關(guan)系這一焦(jiao)點問題(Emerson),當事人各執一詞,并形(xing)成如下對抗意見:

1.朱(zhu)某(mou)(mou)自備(bei)勞動(dong)(dong)(dong)(dong)(dong)工(gong)具(ju)是否影響(influence)勞動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)的成立原告認為(wei)朱(zhu)某(mou)(mou)雖然(ran)自備(bei)車輛,但是開(kai)車所(suo)需(xu)的油費、過路費甚(shen)至(zhi)違章罰款費都由(you)(you)A公(gong)(gong)司(si)(si)(si)(si)承(cheng)(cheng)擔。如果朱(zhu)某(mou)(mou)是搞個體運輸(shu)的,那么上(shang)述費用(yong)開(kai)支由(you)(you)A公(gong)(gong)司(si)(si)(si)(si)承(cheng)(cheng)擔顯然(ran)不符(fu)合(he)邏輯。因此,合(he)理解釋(shi)是朱(zhu)某(mou)(mou)所(suo)有的機(ji)動(dong)(dong)(dong)(dong)(dong)車與A公(gong)(gong)司(si)(si)(si)(si)的關(guan)(guan)(guan)系(xi)(xi)屬(shu)租賃關(guan)(guan)(guan)系(xi)(xi),而朱(zhu)某(mou)(mou)與A公(gong)(gong)司(si)(si)(si)(si)的關(guan)(guan)(guan)系(xi)(xi)屬(shu)勞動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)。被(bei)告則(ze)認為(wei)朱(zhu)某(mou)(mou)自備(bei)勞動(dong)(dong)(dong)(dong)(dong)工(gong)具(ju)是為(wei)A公(gong)(gong)司(si)(si)(si)(si)提(ti)供勞動(dong)(dong)(dong)(dong)(dong)服務。第三人A公(gong)(gong)司(si)(si)(si)(si)認為(wei),在勞動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi)里(li),生(sheng)產工(gong)具(ju)是由(you)(you)用(yong)人單位提(ti)供的;而在勞務關(guan)(guan)(guan)系(xi)(xi)里(li),生(sheng)產工(gong)具(ju)則(ze)是由(you)(you)勞動(dong)(dong)(dong)(dong)(dong)者自己提(ti)供的。朱(zhu)某(mou)(mou)自備(bei)小貨(huo)車為(wei)A公(gong)(gong)司(si)(si)(si)(si)提(ti)供運輸(shu)服務,二(er)者之間不是勞動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)系(xi)(xi),而是勞務關(guan)(guan)(guan)系(xi)(xi)。

2.朱某與(yu)A公(gong)司(Company)之間(jian)的(de)關(guan)系是(shi)否具(ju)有(you)(you)臨(lin)時性(xing)、短期性(xing)的(de)特性(xing)?被告及第三人認(ren)為(wei)由于A公(gong)司從事的(de)生產(chan)具(ju)有(you)(you)明顯的(de)季(ji)節性(xing),每年生產(chan)的(de)時間(jian)也就是(shi)2-3個(ge)月。在(zai)此情況(kuang)下,朱某為(wei)其(qi)提(ti)供(gong)運輸(shu)服務具(ju)有(you)(you)短期性(xing)、臨(lin)時性(xing)的(de)特點,這符合勞(lao)務關(guan)系的(de)特點,而勞(lao)動關(guan)系一般比較穩(wen)定,時間(jian)較長,試用期都(dou)會(hui)有(you)(you)3個(ge)月。原告認(ren)為(wei),上述(shu)認(ren)定具(ju)有(you)(you)主觀臆測(ce)性(xing),難以維護眾(zhong)多臨(lin)時打工(gong)者的(de)合法權益,而且A公(gong)司的(de)生產(chan)季(ji)節性(xing)強,使得勞(lao)動者不(bu)可能(neng)長期提(ti)供(gong)勞(lao)動。

3.A公(gong)司(si)(si)(si)(Company)與(yu)(yu)朱(zhu)(zhu)某(mou)之間是否(fou)存(cun)在(zai)管(guan)(guan)理(li)與(yu)(yu)被管(guan)(guan)理(li)關(guan)系?被告(gao)及(ji)第三人(ren)認為,證據表(biao)明朱(zhu)(zhu)某(mou)用車以外的(de)時(shi)間由(you)朱(zhu)(zhu)某(mou)自由(you)支配(pei)(包括為其(qi)他人(ren)提(ti)供(gong)運輸服務(wu)),不(bu)受原(yuan)告(gao)規章制度的(de)約束。因此,A公(gong)司(si)(si)(si)與(yu)(yu)朱(zhu)(zhu)某(mou)不(bu)存(cun)在(zai)管(guan)(guan)理(li)與(yu)(yu)被管(guan)(guan)理(li)關(guan)系。原(yuan)告(gao)則認為在(zai)朱(zhu)(zhu)某(mou)為A公(gong)司(si)(si)(si)工(gong)作期間,其(qi)日常生活起居均在(zai)公(gong)司(si)(si)(si),A公(gong)司(si)(si)(si)免(mian)費為朱(zhu)(zhu)某(mou)提(ti)供(gong)吃住并每月支付(fu)朱(zhu)(zhu)某(mou)工(gong)資2000元,而且有(you)證據表(biao)明朱(zhu)(zhu)某(mou)除承擔運輸工(gong)作外,還受相關(guan)主(zhu)管(guan)(guan)人(ren)員指派從事(shi)縫紉(ren)機(ji)的(de)修理(li)等工(gong)作。至于(yu)朱(zhu)(zhu)某(mou)在(zai)公(gong)司(si)(si)(si)比較自由(you),是由(you)于(yu)公(gong)司(si)(si)(si)沒有(you)健全(quan)公(gong)司(si)(si)(si)的(de)內(nei)部管(guan)(guan)理(li)制度(Management system),不(bu)能因此否(fou)認A公(gong)司(si)(si)(si)與(yu)(yu)朱(zhu)(zhu)某(mou)之間存(cun)在(zai)管(guan)(guan)理(li)與(yu)(yu)被管(guan)(guan)理(li)關(guan)系。

[法院(yuan)審理]

法(fa)院審理(li)后認(ren)為(wei)(wei),本案訴爭的(de)(de)(de)(de)是(shi)(shi)(shi)被(bei)(bei)告(gao)工(gong)(gong)傷調查(cha)結(jie)論(lun)的(de)(de)(de)(de)具(ju)體(ti)行政(zheng)行為(wei)(wei),被(bei)(bei)告(gao)作(zuo)(zuo)為(wei)(wei)勞(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)(bao)障(zhang)(起(qi)保(bao)(bao)障(zhang)作(zuo)(zuo)用(yong)的(de)(de)(de)(de)事(shi)物(wu))行政(zheng)管(guan)(guan)(guan)理(li)(public administration)部門(men),在(zai)其(qi)(qi)(qi)(qi)職(zhi)權范圍內(nei),根據原(yuan)告(gao)的(de)(de)(de)(de)申請,對原(yuan)告(gao)之(zhi)夫朱(zhu)某的(de)(de)(de)(de)死亡(wang)(wang)是(shi)(shi)(shi)否屬(shu)于工(gong)(gong)傷作(zuo)(zuo)出(chu)認(ren)定是(shi)(shi)(shi)其(qi)(qi)(qi)(qi)法(fa)定職(zhi)責。工(gong)(gong)傷認(ren)定的(de)(de)(de)(de)前提是(shi)(shi)(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)者與(yu)(yu)用(yong)人(ren)單位成(cheng)立具(ju)有(you)(you)管(guan)(guan)(guan)理(li)性(xing)質的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)關系(xi)。本案中(zhong),第三人(ren)A公(gong)司主要從(cong)事(shi)床(chuang)上用(yong)品的(de)(de)(de)(de)生(sheng)產(chan)、銷售(shou),生(sheng)產(chan)季節性(xing)較(jiao)強,主要集中(zhong)在(zai)每年7月至9月,其(qi)(qi)(qi)(qi)特殊性(xing)使得勞(lao)(lao)(lao)(lao)(lao)動(dong)者不(bu)可能長期(qi)(qi)不(bu)間斷(duan)地為(wei)(wei)其(qi)(qi)(qi)(qi)提供勞(lao)(lao)(lao)(lao)(lao)動(dong)力(li)。且(qie)勞(lao)(lao)(lao)(lao)(lao)動(dong)者提供勞(lao)(lao)(lao)(lao)(lao)動(dong)的(de)(de)(de)(de)形式也(ye)具(ju)有(you)(you)多樣性(xing)。朱(zhu)某自備生(sheng)產(chan)工(gong)(gong)具(ju)在(zai)該公(gong)司從(cong)事(shi)運輸等(deng)工(gong)(gong)作(zuo)(zuo)期(qi)(qi)間,有(you)(you)固(gu)定的(de)(de)(de)(de)月收(shou)入,車輛的(de)(de)(de)(de)相關(related)費用(yong)(expense)也(ye)由(you)公(gong)司承擔,顯(xian)然雙(shuang)方具(ju)有(you)(you)一定的(de)(de)(de)(de)管(guan)(guan)(guan)理(li)與(yu)(yu)被(bei)(bei)管(guan)(guan)(guan)理(li)關系(xi)。朱(zhu)某工(gong)(gong)作(zuo)(zuo)之(zhi)余較(jiao)為(wei)(wei)自由(you),也(ye)未與(yu)(yu)公(gong)司簽(qian)訂書面的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)合同,這是(shi)(shi)(shi)該公(gong)司自身尚未健全內(nei)部管(guan)(guan)(guan)理(li)及勞(lao)(lao)(lao)(lao)(lao)動(dong)保(bao)(bao)障(zhang)制度的(de)(de)(de)(de)結(jie)果,不(bu)影響(xiang)雙(shuang)方事(shi)實(Fact)勞(lao)(lao)(lao)(lao)(lao)動(dong)關系(xi)的(de)(de)(de)(de)成(cheng)立。被(bei)(bei)告(gao)認(ren)定朱(zhu)某與(yu)(yu)A公(gong)司不(bu)存在(zai)勞(lao)(lao)(lao)(lao)(lao)動(dong)關系(xi)、朱(zhu)某死亡(wang)(wang)不(bu)屬(shu)于其(qi)(qi)(qi)(qi)管(guan)(guan)(guan)轄范圍的(de)(de)(de)(de)證據尚不(bu)能達到(dao)清楚(chu)而有(you)(you)說服力(li)的(de)(de)(de)(de)證明標準(zhun),其(qi)(qi)(qi)(qi)作(zuo)(zuo)出(chu)的(de)(de)(de)(de)工(gong)(gong)傷調查(cha)結(jie)論(lun)屬(shu)認(ren)定事(shi)實錯誤。遂作(zuo)(zuo)出(chu)判決(jue)(jue),撤銷勞(lao)(lao)(lao)(lao)(lao)動(dong)部門(men)作(zuo)(zuo)出(chu)的(de)(de)(de)(de)工(gong)(gong)傷調查(cha)結(jie)論(lun),并責令其(qi)(qi)(qi)(qi)在(zai)判決(jue)(jue)生(sheng)效后一個(ge)月內(nei)重(zhong)新作(zuo)(zuo)出(chu)具(ju)體(ti)行政(zheng)行為(wei)(wei)。

所謂(wei)勞(lao)(lao)(lao)(lao)(lao)動(dong)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)是(shi)指(zhi),勞(lao)(lao)(lao)(lao)(lao)動(dong)者與用人(ren)(ren)單位(wei)之(zhi)間(jian)存(cun)在(zai)的(de)(de)(de)(de)(de)(de)(de)(de),以(yi)勞(lao)(lao)(lao)(lao)(lao)動(dong)給付(fu)(fu)為目(mu)(mu)(mu)的(de)(de)(de)(de)(de)(de)(de)(de)的(de)(de)(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)權(quan)利義務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)。貴州勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)遣公(gong)(gong)司國外主要以(yi)“項(xiang)(xiang)目(mu)(mu)(mu)型(xing)”派(pai)遣或外包(bao)為主,占整個(ge)勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)遣市場的(de)(de)(de)(de)(de)(de)(de)(de)7成以(yi)上。在(zai)這種(zhong)派(pai)遣和(he)外包(bao)形式(shi)中(zhong),崗位(wei)因項(xiang)(xiang)目(mu)(mu)(mu)的(de)(de)(de)(de)(de)(de)(de)(de)設立而(er)(er)存(cun)在(zai)和(he)結束(shu),項(xiang)(xiang)目(mu)(mu)(mu)周期通(tong)常在(zai)12-15個(ge)星(xing)期左右,崗位(wei)人(ren)(ren)員在(zai)項(xiang)(xiang)目(mu)(mu)(mu)結束(shu)后就由勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)公(gong)(gong)司派(pai)遣到其(qi)他公(gong)(gong)司的(de)(de)(de)(de)(de)(de)(de)(de)項(xiang)(xiang)目(mu)(mu)(mu)工(gong)作。總體而(er)(er)言,以(yi)崗位(wei)而(er)(er)論(lun),存(cun)在(zai)臨時性(xing)、專(zhuan)業性(xing)、輔助性(xing)等(deng)特征(zheng)。勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)是(shi)指(zhi),勞(lao)(lao)(lao)(lao)(lao)動(dong)者為被服(fu)務(wu)(wu)(wu)方(fang)提(ti)供特定的(de)(de)(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)服(fu)務(wu)(wu)(wu),被服(fu)務(wu)(wu)(wu)方(fang)依(yi)照約定支付(fu)(fu)報酬(chou)所產生的(de)(de)(de)(de)(de)(de)(de)(de)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)。浙江省《勞(lao)(lao)(lao)(lao)(lao)動(dong)爭(zheng)議案件疑難問題討論(lun)紀要》對如何(he)區分(fen)勞(lao)(lao)(lao)(lao)(lao)動(dong)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)與勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)進行(xing)了探討,認(ren)為兩者的(de)(de)(de)(de)(de)(de)(de)(de)區別在(zai)于:一(yi)是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)除(chu)了當事(shi)人(ren)(ren)之(zhi)間(jian)債的(de)(de)(de)(de)(de)(de)(de)(de)要素(su)之(zhi)外,還(huan)含有身份的(de)(de)(de)(de)(de)(de)(de)(de)、社會(hui)的(de)(de)(de)(de)(de)(de)(de)(de)要素(su),而(er)(er)勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)則(ze)是(shi)一(yi)種(zhong)單純的(de)(de)(de)(de)(de)(de)(de)(de)債的(de)(de)(de)(de)(de)(de)(de)(de)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi);二是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)(de)當事(shi)人(ren)(ren)之(zhi)間(jian)的(de)(de)(de)(de)(de)(de)(de)(de)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)一(yi)般較為穩定,而(er)(er)勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)當事(shi)人(ren)(ren)之(zhi)間(jian)的(de)(de)(de)(de)(de)(de)(de)(de)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)則(ze)往往具有“臨時性(xing)、短期性(xing)、一(yi)次性(xing)”等(deng)特點;三是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)中(zhong),當事(shi)人(ren)(ren)之(zhi)間(jian)存(cun)在(zai)管理與被管理、支配(pei)與被支配(pei)的(de)(de)(de)(de)(de)(de)(de)(de)社會(hui)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi),勞(lao)(lao)(lao)(lao)(lao)務(wu)(wu)(wu)關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)(de)當事(shi)人(ren)(ren)之(zhi)間(jian)則(ze)不存(cun)在(zai)上述關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi),而(er)(er)是(shi)平(ping)等(deng)主體之(zhi)間(jian)的(de)(de)(de)(de)(de)(de)(de)(de)合同關(guan)(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)。

從字面上理解,上述標準似(si)乎十分明確,但運用到具體案(an)件中卻依然撲(pu)朔(shuo)迷離(li)、難以(yi)界(jie)分。究其原因(yin),主要由兩(liang)個方(fang)面:一是(shi)勞(lao)動(dong)關(guan)系(xi)(xi)(xi)不規范(fan)。幾乎所有(you)的(de)(de)(de)勞(lao)動(dong)關(guan)系(xi)(xi)(xi)與勞(lao)務(láo wù)關(guan)系(xi)(xi)(xi)爭議案(an)件,當事人之間都沒有(you)訂立合(he)(he)同(tong)或(huo)者所訂立的(de)(de)(de)合(he)(he)同(tong)沒有(you)明確的(de)(de)(de)約定,雙方(fang)的(de)(de)(de)權利義務介(jie)于非(fei)“驢”非(fei)“馬”之間。二是(shi)勞(lao)動(dong)關(guan)系(xi)(xi)(xi)的(de)(de)(de)多(duo)元(yuan)化。隨著社會的(de)(de)(de)發(fa)展,我國(guo)的(de)(de)(de)勞(lao)動(dong)力市場(shì chǎng)愈加活躍,用人形(xing)式也(ye)更為靈活多(duo)樣(yang),新型勞(lao)動(dong)關(guan)系(xi)(xi)(xi)大量出現,并且勞(lao)動(dong)關(guan)系(xi)(xi)(xi)與勞(lao)務關(guan)系(xi)(xi)(xi)的(de)(de)(de)客觀特征正在逐步(step by step)模(mo)糊。

如在本案中(zhong),朱(zhu)某與A公(gong)司似乎(hu)形成勞務關系,因為(wei):

1.朱(zhu)某自(zi)備車輛為A公司(Company)提供運輸。一般勞(lao)動關系中,生產(Produce)工具是用(yong)人(ren)單(dan)位(wei)(unit)提供的,而勞(lao)務(wu)關系里,生產工具通常是服務(wu)方自(zi)己提供的。

2.朱某只在每年7月(yue)(yue)至(zhi)9月(yue)(yue)的生產旺季(ji)(產品(pin)產量(liang)、銷售量(liang)增加的時(shi)期(qi)(qi)或時(shi)節)階段進入(ru)A公司(Company)工(gong)作,似乎符(fu)合(he)勞務關系“臨(lin)時(shi)性(xing)、短(duan)期(qi)(qi)性(xing)”的特點(dian)。

3.A公司對朱某(mou)上下班的(de)(de)時(shi)間(jian)沒有明確規定(ding)(guī dìng),用車以外(wai)的(de)(de)時(shi)間(jian)自(zi)由(you)支配度(du)較大,與一(yi)般勞動關(guan)系(xi)中用人單(dan)位(unit)與勞動者之間(jian)嚴格(ge)的(de)(de)管(guan)理與被管(guan)理關(guan)系(xi)有一(yi)定(ding)程(cheng)度(du)的(de)(de)差異。貴州(zhou)勞務外(wai)包(bao)(bao)為外(wai)包(bao)(bao)已(yi)經成為一(yi)個獨(du)立于企(qi)業之外(wai)的(de)(de)過(guo)程(cheng),而且許多基礎(chu)數據都已(yi)經不在企(qi)業內部,這(zhe)樣導致了一(yi)個嚴峻的(de)(de)現實問題:如(ru)何(he)將(jiang)生產(chan)外(wai)包(bao)(bao)作(zuo)為一(yi)個獨(du)立過(guo)程(cheng)而仍(reng)將(jiang)成為企(qi)業整體流(liu)程(cheng)管(guan)理的(de)(de)一(yi)部分(fen),這(zhe)將(jiang)是管(guan)理生產(chan)外(wai)包(bao)(bao)的(de)(de)核心(xin)。

然而,在我(wo)國勞(lao)動關(guan)(guan)(guan)系(xi)(xi)的內(nei)涵(han)發(fa)生重大變化、勞(lao)動關(guan)(guan)(guan)系(xi)(xi)與勞(lao)務關(guan)(guan)(guan)系(xi)(xi)的客觀特征正逐步模糊的背景下,人民(min)(min)法(fa)院(yuan)應(ying)從保護(hu)勞(lao)動者(zhe)合(he)法(fa)權益(yi)的立法(fa)精神出發(fa),突破現行的狹隘界定和傳統觀念的慣性(xing)影響,對(dui)勞(lao)動關(guan)(guan)(guan)系(xi)(xi)作合(he)理(li)的擴大解釋,從實質上靈(ling)活地把(ba)握勞(lao)動關(guan)(guan)(guan)系(xi)(xi)與勞(lao)務關(guan)(guan)(guan)系(xi)(xi)的界限。人民(min)(min)法(fa)院(yuan)對(dui)該案的審(shen)理(li)即充(chong)分地體現了這一點(dian)。
